FurballRescue SaaS Subscription Agreement
Effective: April 2026
This Subscription Agreement ("Agreement") is entered into between Really Small LLC, a North Carolina limited liability company ("Provider"), operating the FurballRescue platform; and the subscribing organization identified during the sign-up process ("Customer").
By subscribing to the Service, Customer agrees to be bound by this Agreement.
1. Service Description
Provider operates a cloud-hosted animal rescue management platform. The Service is provided on a single-tier basis — all features are included in every subscription.
2. Subscription and Payment
The subscription is month-to-month, renews automatically, and may be cancelled at any time. Standard fee is $80/month. Promotional and referral rates may apply as described at sign-up. Founding Partner subscriptions are $15/month, locked for the life of the subscription.
3. Data Ownership
Customer retains all right, title, and interest in Customer Data. Provider will not sell or share Customer Data. Customer may export their complete database at any time.
4. Data Processing
Customer is the data controller; Provider is the data processor. Each tenant's data is stored in a separate, dedicated database. Provider processes data solely to provide the Service.
5. Third-Party Services
The Service integrates with Stripe (payments), Amazon SES/SNS (email/SMS), and RescueGroups/Petfinder/Adopt-a-Pet (animal listing syndication).
6. Service Availability
The Service is provided on a best-effort basis. Automated daily backups are performed with 30-day daily and 12-month monthly retention. Customer may self-service restore from any backup.
7. Security
Provider implements HTTPS encryption, security headers, password hashing, account lockout, rate limiting, credential encryption at rest, audit logging, and per-tenant database isolation.
8. Customer Responsibilities
Customer is responsible for maintaining account security, ensuring authorized user compliance, complying with applicable laws, and maintaining their own Terms of Service and Privacy Policy.
9. Termination
Either party may terminate. Upon termination, Customer has 30 days to export data. After 30 days, Provider may permanently delete the tenant database.
10. Limitation of Liability
Provider's total liability is limited to fees paid in the preceding 12 months. Provider is not liable for indirect, incidental, special, or consequential damages.
11. Modifications
Provider may modify this Agreement with 30 days' written notice. Customer may terminate without penalty within 30 days of receiving notice of a material change.
12. Governing Law
This Agreement is governed by the laws of North Carolina. Disputes shall be resolved in the courts of Dare County, North Carolina.
